well, he's got alcohol on the head that's why..... d!imw!ted rider. i bet that all of his companions were not arrested even if they were drunk driving. they were not arrested or given a violation ticket. i think that's the trend. the apprehending officer told me they just advise drivers who are slightly drunk go home straight and ride slowly. unless of course they are really drunk. the problem is, lespu don't have devices to measure alcohol in breath. tables can be turned against them if they don't have clear proof of drunk driving.

Hey Sir theflea, your lucky, glad your ok, just wanted to share my experience, I think the year was 1992 or 93, I was in Paz St. in Paco Manila on my way home, when a jeep went straight at me, because he was trying avoid a pot hole on his lane, then Bang, it was 6pm semi dark, as usual he has no headlights (typical PUJ), I managed to turn to the sidewalk but the jeep had steel poles hanging out from the 2 ends of the bumper, so his left side hit my left hand which broke my finger together with the handle brakelever and everything in sight. Well I managed to catch up to him by foot, because there was a busy intersection, or he couldve "hit and run" me. Holding on to my finger he brought me to PGH, my finger is intact now hehe, I stopped biking eversince, till last year again. So hearing stuff like this gives me the creeps again. But thanks to my new found friends at PinoyMTBiker, I am more confident in biking even busy streets, but of course still with extreme caution. Just be careful all the time. And I hope that young as@#%@^&@ that hit you doesnt grow old anymore!!!

Let me tell a story about my officemate...
he was inside his car...patiently waiting for the red traffic lights to go green when suddenly, a kid (yep 19 years old) on a motorcycle from the other direction suddenly swerved to his lane and hit the front of his car. The kid, badly hurt, landed in his windshield. My officemate felt he had to do something even if he wasn't the one at fault--he was on a complete stop.
he took the kid to the hospital, and feeling very "good-samaritanish" he also paid for the kid's hospital expenses...and because he did not file a complaint against the kid, he shouldered the repairs on his car.
Fast forward a few months, after some smart-a$$ judge uncle of the kid thought it wise to file a case against my officemate for damages--physical injury, moral, ek ek. My poor officemate ended up agreeing to a 50,000 peso settlement...for "doing the right thing".
what if the kid killed the other woman? what if the kid killed you? do you think, if he ever pleaded with your mom and cried, and said sorry, he will be forgiven? would it still be the right thing?
morbid thoughts from a morbid guy...
but i do hope that kid doesn't finally kill somebody in the future . . .
and oh, he's not a kid anymore.

Why did he settle? Well I hope the kid's uncle gets killed by the kid hehe

sabretooth, tsk tsk tsk....he should've gotten a lespu report prior to bringing the kid to the hospital leflea, i have to take note of that settlement thing where i can't be charged in the future, he he he

my officemate then was "feeling-mabait/mayaman"... when he thought his pure act of kindness would make a difference, he was actually making a big mistake. he had to settle just to stop the court appearances, etc, etc. well he had the money naman.
protection from future lawsuits? hmm...that's something to remember...

Interesting, how would you go about on doing this? Honestly, for my case my first action will be to bring the kid to the nearest hospital...but seems it would be more beneficial to look after my butt first. Would taking pictures of the actual accident help, we know it sometime takes ages for a lespu to respond.

lespu said pictures are strong evidence, add time if your camera has this feature. for example, angle and point of impact could help a lot in determining how the actual events transpired.

Its a good thing you are safe, I was hit by a motorcycle when I was 12 on my way home (on my first mountain bike at that), They idiot decided to overtake at an intersection (how stupid is that) and hit me on my rear wheel tacoing the wheel and sending me careening of into the pavement, it was a hit and run because the motorcycle rider did not even bother to ask if I was ok, sustained some wounds but survived. grrr...
